An American Constitutional Crisis
The Supreme Court of the United States is the final arbiter of law…but most of the times they don’t take up the case. This week they refused to take up election fraud, but they ordered the release of President Trump’s tax returns. Even with conservative justices, the SCOTUS is still a government agency that will let us down time and time again. Today’s we’ll look at the issues and ramifications of the action and inaction of the court.

If you’ve been on social media for even a few minutes, you have seen the posts from folks promising the Supreme Court of the United States would fix the election problems. While I wish we could put faith in a government institution and see results, Fact is, government is not the solution. Just look at the abortion issue. Heck, that constitutional crisis has been ongoing since 1973. This week, the Supreme Court of the United States has struck again, and in today’s episode, we’ll discuss the issues and ramifications. Welcome to the conservatives guide to American politics. My name is Ed Bejarana. And I am an otherwise happy go lucky conservative, who enjoys life in North Idaho with his wife and two golden retrievers. For all intents and purposes, I keep to myself and think your folks should live and let live, you know, do unto others as you would have them do unto you. But I am frustrated watching the news. All I really tune in to see is the weather and maybe some local interest stories. But most of what they show me is their political biases socialistic tendencies, the American media is no longer neutral. Instead, they use their megaphone to influence political power. The ideals of America have been hijacked by people who otherwise dislike or hate American ideology. I started this podcast as my way to fight back from my little slice of America. Call it a rallying cry for other common sense conservatives to arm themselves against the onslaught of negativity. It is time the America hating progressives hear from the silent majority. It is time for conservatives to stand up and be heard. It is tough to look at the direction of our nation and not get depressed. I bet you are struggling day to day because of the canceled culture, crazy ideas being discussed in DC and the Supreme Court seeming to pass on their constitutional obligations. Many times I’ve wondered if I’ve been I don’t know stuck in a coma for 20 years and woke in some alternative reality. Maybe I’ll wake up for real and everything will go back to normal. Then one of my grandchildren post something on Facebook and Nope, we are screwed. I read a article a few weeks ago on American thinker.com by john green. I contemplated reaching out to john and inviting him on the show. I still might but since he lives in Idaho, but I wanted to wait until after the Supreme Court of the United States ruled on the election case scheduled for February 19. Based on how SCOTUS ruled today, I’m gonna read some of John’s article and I don’t know weave my commentary in the middle. All is not lost. I say I still hold out belief that the progressives will overplay their hand and the states controlled by Republicans will, and I’ll turn back neon slot. But let’s let’s first go through the article and, and then I’ll give my glass half full perspective as is typical. So the title is the real constitutional crisis is upon us by john green published on American thinker.com. It starts. We’ve heard repeated claims over the course of the Trump presidency, that we’re facing a constitutional crisis. We’ve been told that everything from executive orders to impeachment proceedings, were such a crisis. Now, I gotta stop here for just a second. When a republican does it, it just seems like it’s bad. Right? I mean, whenever the news is reporting anything and Republican does, it’s bad. Let’s take Ted Cruz as an example. The man takes his family to Cancun during a storm. Bad. Joe Biden hides in his basement during the entire election. Good. And, and we’re getting used to the hypocrisy. Without the media cover. Of course, no politician would be safe, but the media loves the Democrats. They want socialism. They want communism. So anything republicans do bad, anything democrats do good. They’re redefining language. This is the speech police in full swing. Several weeks ago, we did an episode about being gaslighted.
We all of these things are happening all at once. By redefining language. The Democrats continue to control the narrative. And we as Republicans, we just chase the narrative. We never really talk about issues. Our politicians in office, they’re so weak and and enable to make a cohesive argument that all we’re talking about are the things that the progressives, the communists, the socialists, however you want to call them, we’re only talking about those things. We’re not talking about the issues that are important to Americans, gas prices have increased 45 cents per gallon since Biden has taken office. Let me continue the article. But what about when the Constitution is ignored rather than respected? In that case, it will cease being a guarantee of our rights or a constraint on government overreach. Under those circumstances, the Constitution will no longer have any bearing on how we conduct ourselves as a nation, it will become nothing more than an interesting historical document. That will be a true constitutional crisis. And it’s rapidly approaching. Okay, so inserting my commentary here, based on how the Supreme Court of the United States decided two very important rulings against and or for President Trump. We are facing a dilemma. As I opened up the show so many folks you hear say, Well, once it gets to the Supreme Court, we’ve got, we’ve got a conservative court now. They’re gonna rule in Trump’s favor, and everything’s gonna go back to normal. But I’ve said on this show numerous times the difference between a liberal and a conservative, a liberal trusts their politicians, implicitly, everything they say is gospel. They don’t believe in religion, but their religion is the Democratic Party. Whereas a conservative, we don’t trust any politician. If their lips are moving, they’re lined. And that’s been the weakness. We we do not put our faith in politics. We don’t elect leaders. We do not elect rulers. We elect servants. You go to Washington, DC to serve your constituency, not rule them. So the Supreme Court of the United States decided that the election in Pennsylvania, it’s it’s done, it’s over. There’s nothing that can be done about it. So there’s no sense hearing the case. That would that was the ruling, that that was the majority ruling. There’s nothing good that could be done about it anyway, so we’re not going to take the case. Justice Thompson wrote a scathing rebuttal. I won’t be reading it in today’s episode, but it is worth looking up. And then in part of our Constitution is no law shall be created to target the individual. The individual should be protected from the the over burden, the power the immense power of the government. But the Supreme Court decided, Well, yeah, President Trump’s taxes should be released in New York. No, they don’t have anything concrete. They don’t have actually a a warrant. A statement of wrongdoing. They just want us tax return so that they can you know, maybe dig something up. Your you see what’s happening here, on one hand, the election, and we can’t do anything about it. But on the taxes. No, there’s there’s actually no crime. That’s outline. There’s no stated wrongdoing. But here you go. Here’s a private document. Go ahead and see if you can find anything. You get what’s happening here. You see how these two things are connected. Same body, same day, completely opposite results.
Let me continue in the article. The Supreme Court is supposed to be our bulwark against encroachment on the Constitution. The justices are not only to be the interpreters of the Constitution, but also its garden guardians. They are the robes scholars intended to understand the constitution inside and out and to ensure the nation remains faithful to it. They are granted lifetime appointments so that they may remain above petty politics. justices are intended to be free of party affiliation, so that they may defend the constitution, independent of outside influences. Somewhere along the line, the Supreme Court decided that it not only wanted to keep the constitution relevant, I wanted the constitution to evolve with the times that now, there’s a little bit in, in the article that talks about an asteroid. You know, we all fear the day, when an asteroid strikes Planet Earth again, it’s happened millions of times, we’ve had Extinction Level events with a big asteroid hits us. And it’s going to happen again, sooner or later, an asteroid is going to hit us. And and we’ve got scientists are pointing their telescopes out looking for these big asteroids to try to detect them ahead of time. So the analogy goes like this, if if we can find the asteroid soon enough, then the amount of pressure that we need to put on the asteroid to change the trajectory is minor, which we really only have to just put a little bit of energy in order to fix it so that the asteroid won’t hit Earth. Using that analogy, on the constitutional crises, it works the same way, if we could see it far enough in advance, it wouldn’t take a lot of energy to deflect the constitutional crises. Right now, we’ve got a situation where when the court rules, they create new constitutional rights. And when the court doesn’t rule, they create constitutional rights. Let me ask this question was abortion. A new right created by the court 1973. Court ruled Roe v. Wade, that the woman could abort the fetus. During the first trimester, I’m not going to debate the issue. But what was not allowed before by the court was now made legal, hence constitutional. So what is wrong with legislating through the Supreme Court of the United States? I mean, if if you can’t get Congress to do it, if you can’t get the president to push for it, why not have the courts rule it? You know, the problem is that these justices are appointed to a lifetime position. They’re, they’re appointed by a partisan. They are not beholden to the voters. Our system of government is set up such that you the voter, gets to change things if you don’t like the direction. You know, we talked about the pendulum swing in America, you know, used to be every seven years the pendulum would swing from the right to the left and back to the right. That’s because once one side got in power and controlled everything, they did something stupid. And then we said, Oh, no, you don’t. And we’d vote them out of office and vote the other side in and well, then they do something stupid. And it goes back and forth. But what the court, yeah, we can’t get these people off the court for decades. Look at this, let me ask you this another way if the court could create abortion rights, what about health care? Let’s go back to the article. In 2012, one of its most notorious rulings landed on the American people.
The Affordable Care Act, aka Obamacare, has been challenged on the grounds that it was unconstitutional for the government to require citizens to buy products from private companies and find them if they fail to do so. As part of the argument supporting Obamacare, the drafters of the legislation argued the fine was not attacks. In spite of this, the court ruled that Obamacare was constitutional because the government has the right to levy taxes. And the fine was really a tax, even though the legislation said it wasn’t. Why is it bad to use the courts to make the law because there’s just as stupid as the politicians. Sure, they may not have a D or an R after their position or their seat on the Supreme Court, but they are a D or an R. They have political biases. Every justice does Just because they got a black robe on, doesn’t mean they’re not going to rule with their bias. Now imagine this, we know that justices are just as human, as the legislators who fail to act on our behalf. Imagine if you could just pick the judge you want for your case. So we’ve got a case on, you know, a puppy mill. And the district that I’m in the judge has has really been very strict on puppy mills. So wouldn’t it be great if I can just go to another district where the judge is not so strict on puppy mills? Well, that’s kind of how is working. We’ve got national campaigns that are working against America. And rather than file their case in northern Idaho, where they’re not going to get a liberal representation, they race to Seattle or San Francisco or New York, someplace where they’ve got a liberal favor. What if a judge disagrees with the elected representatives? Hmm. Let’s go back to the article. We also saw judges unilaterally appropriating the powers of Department of Justice. The DOJ has the sole authority to decide when and when not to prosecute someone. Yet, when DOJ decided to drop charges against Michael Flynn, Judge Emmett Sullivan decided to appoint his own prosecutor and continue the proceedings against Flynn. He became judge, prosecutor, and jury all wrapped up in one rope. Here we are, we finally arrived to the meat of today’s episode some 17 minutes into the program. Can the constitution be changed by the Supreme Court of the United States taking no action? Let me state that a different way. If if the Supreme Court doesn’t rule on a decision, does it become a constitutional norm does it become precedent? The author of the article writes, the end of Donald Trump’s first term brought us the election of 2021 of our most sacred rights is the right to vote in free and fair elections. In response to COVID-19. Numerous election officials announced their intent to conduct the election contrary to applicable laws, the Supreme Court had a chance to say no, but instead took a pass. Now, when our union was formed, states made a strict agreement on how elections were going to be run. They did not want a federalist form where a president and a congress dictated to the other 50 states or however many back then there weren’t 50. But the states were not going to accept rule by edict from some centralized location. They wanted to maintain their rights. And one of those essential rights was selecting the representatives choosing the electorate’s who would elect the president. And therefore, our Constitution is written such that the states will make the rules for votes. However, it was very specific, the state legislature would make the ruling as to how elections would be run. Not one man, not a judge, not the governor, the legislature constant constitutionally, that’s exactly where
the law states, the choices made in the legislature. The article continues after the election with a mountain of irregularities. The court again had a chance to ensure election integrity. Through a public hearing of the evidence and unbiased adjudication of its implications. The Supreme Court again took a pass in doing so the justices effectively announced they had no interest in defending the citizenry, his right to fair elections, let that sink in our constitutional guardians opted out of defending our constitutional rights. Okay, so let’s go through this. before the election, some election people in various states decided because of the pandemic, we’re not going to run the election the way we were before. We’re we’re gonna we’re gonna do a different we’re gonna change the rules. weeks before the Actual election. President Trump’s team took that to court. The lower courts. We like it, we’re Democrat, we like it. So it goes to the Supreme Court, the Supreme Court says that’s a state’s issue. That’s not something that we’re going to take up. Nevermind the fact that it’s not a state’s issue. It’s an American Constitution issue. Constitution says very clearly, that it’s the legislature to changes rules, not an individual. Okay, so the election happens, and what happens? Well, there’s fraud, massive fraud. So Trump’s team takes it back to the courts. court after court refuses to hear it because well, the elections done. What kind of mess would America be in? If we overturn the election now goes all the way to the Supreme Court, Supreme Court says what? Well, there’s no sense taken up the case, because there’s nothing we can do about it. How’s it Really? We can’t change it. Anyway. The elections done the the new president is installed. Nevermind date, we we need to fix the problem going forward. So Americans have trust in the election system. So now has this become a constitutional amendment? The ability to change the rules, without legislative oversight, just weeks before the election? Well, the Supreme Court didn’t act, precedent has been set. Half a dozen states made changes. And the Supreme Court has said a state’s issue, not something we’re going to tread into. You know, it seems like what the court is saying that we don’t want to tread into this election issue, because, well, the evidence isn’t really clear. You know, we don’t want to listen to the evidence, but it’s just not clear. You know, it might be that they don’t want to discover what’s happening. They don’t want the evidence to become public. Because what does that mean to our nation? If we can no longer trust that our votes? Count? So the Supreme Court is going on a technicality. Well, there, there’s no evidence, there’s no clear evidence, so therefore, we’ll just take a pass. And then, literally in the same day, they release a ruling. On another case, where there is no clear evidence. The state of New York is suing the president, President Trump to get his tax returns. They think he’s broken the law. They don’t know that he’s broken the law. They just think he’s broken the law. They think he’s violated state’s taxing rules. So they want to get a hold of his tax returns. And the President has been fighting this for years. Tell me what law I’ve broken, produce a warrant, produce something that says what it is I’ve done wrong. Imagine if you will, let me let me rephrase this. The police come to your door, they knock on your door, you open the door, and they say, let me uh we want to search your house. What’s the first thing that comes out of your mouth? Show me your warrant. And on that warrant, it’s supposed to say, we’re here looking for this. We think you’ve done this, get out of my way, I’m going to go search your house. But no, they don’t have a warrant. They don’t have a specific thing. They’re not coming to your door saying we’re looking for a gun.
No, just show me your show me your taxes. We’ll find what we want to find. So the Supreme Court this is this is just an obvious slam dunk. There’s no evidence. There’s no clear evidence to warrant the release of this financial documentation. And the court just ruled that without clear evidence, they’re not going to take up the case. So what they do, they took up the case. And they released the President’s tax returns. So it’s not that the court doesn’t want to take action. It just seems like the court doesn’t want to take action to protect conservatives. Even though there’s a bunch of conservatives on the court. Now I’ll include a link to the article in today’s show notes. I really, I didn’t read. But half of it if that. I suggest you visit the link and read the full article. It’s actually very good john. I read all of his articles on American thinker.com and he’s a great author. And this article really touches on some key points. But day after day, it feels like Biden and the democrat controlled Congress is moving America further and further left. Getting to speak in code. The Democrats are moving America closer and closer to communism. In the next few weeks, I am interviewing some folks who escaped from communist controlled Russia and came to America to make a better life. Some of those interviews are from my local show Idaho speaks, but I’m going to try and work some of the content in here on the national program. I studied Russian history in high school, honestly, it was one of my favorite classes in high school, the teacher was a lover of Russian history. And he was an American patriot through and through, he highlighted all the bad things the communists did, and how America system was superior. He was a real critical thinker who valued history, as he knew if we didn’t know history, we were doomed to repeat it. Now companies like Coca Cola are giving employee training sessions to people to be less white. Dear Lord, when we say it can’t get any worse. Today’s conclusion isn’t one that said everything will be rosy. No, no, I usually go that route anyway. But I ultimately think everything will work out in the end. I don’t happen to think I’ll be around to see the conclusion of this new war against America. But I do believe Americans will win. I served in the US Army during the Cold War. I got out just a few weeks before the start of Desert Storm. While I did not have to dodge bullets during my service, I had the stand in the breach to deter a nuclear exchange. The war we’re fighting today is so far the cancel war. This is the McCarthy era all over again. Only it isn’t Hollywood be uncensored. being accused of being commie bastards, it is you and I being called fascist. Ironically, we’re being called fascist by fascists. But another episode, you see, the left has merged multiple issues in the mix and are capitalizing on the pandemic to enhance the panic. They have racism and insurrection slash treason and, and then disinformation. They are rolling all of this up to justify widespread censorship. And then they limit access to debate through means of the pandemic. Here in my hometown, they allow so few people in the meeting rooms, that the elected officials don’t feel the anger from the community. It would be fine if not for election fraud. The stuff that happened last November, and again in December shows the democrats know just how to steal an election. I probably get censored for say that, however, how can they say my words are disinformation, when the Supreme Court of the United States is refusing to hear the evidence because the results cannot be changed at this point. They are using the lack of a fair trial as evidence that there is no evidence. Let me say that, again. They are using the lack of a fair trial as evidence that there is no evidence. What is happening is you and I are getting so frustrated that we’re tuning out.
Several of my friends have announced they are done with politics. If that is true, then we are doomed. If you and I stopped trying, then we all lose. Our saving grace is staying tuned in and winning local races. I’m not talking about Congress or the White House. Sure. Let’s try again in a couple of years. But I’m talking about the local school board, city council county commission waterboard and every other elected seat in your local area and state, we must re install conservative values in elected office. We need to bring God back to the public square. We need to turn back the socialist and communist tide. And we can only do that by holding the seats of power. Those seats that are used to launch political careers. The political careers we need to start are for good conservative thinkers. If we can hold a majority of the state houses if we can capture a majority of school boards if if we can make the local political environment safe for conservative ideas, then we can save America. This model can work anywhere in America. We need the channel to fight against the progressive controlled media and give our conservative candidates a chance to speak directly to the voters. We can’t wait until the election to start it. We have to start it now. We’ve got to build up the audience. We’ve got to talk about issues ongoing. Not in a last ditch effort. We’re gonna vote on this next week kind of way. But in a conversation, is this what you want for America? Do you want it such that we tax everybody and give checks to those who are not working? Do we want it such where we legalize pot because they just want to get stoned. Facebook, Twitter and Google are not going to allow fair presentation, we must create our own channel.
